The Asbury Park High School teacher fined for making a call on her cell phone during a class will not appeal the state Education Commissioner’s ruling on the case her lawyer said.

Stephen B. Hunter said veteran performing arts teacher Desley Getty acknowledged she made a mistake, accepted the penalty pet insurance, and wants to move forward.

“It was a misjudgment,” he said. “But she is a decorated teacher with a great love for kids”

Hunter said the 120-day salary forfeiture will be based on calendar days and will cost Getty about $22,000 based on a base salary of about $70,000. A previous story had estimated the penalty at as much as $50,000 based on 120 work days chicago mortgage loans.

Getty serves as an advocate for students in court, and the call she made while covering a class for another teacher was to get advice on a case. But that call did violate the district policy on faculty use of cell phones in school. A student in the class videotaped other students dancing while Getty was on the phone, then posted the video on YouTube. It has since been removed.

Getty was reprimanded, and the school board later filed tenure charges to remove her. Following a hearing, an administrative law judge recommended that the penalty be limited to the reprimand and loss of 120 days salary. The state Education Commissioner, who makes the final decision atlanta investment property, agreed.

Hunter said he always advises teachers that there is zero tolerance today, and with modern technology, they can never be sure they are not being recorded.

“I always say, assume everything you do is being videoed,” he said.
